Terms and Conditions

• All riders will be 8 years old or older.
• All riders will wear covered-in shoes
• All riders will wear helmets. (Available for hire, price included in kart rental)
• All riders will follow all course marshal instructions. 
• All riders will have fun.
• No contact between karts, if you are being overtaken, slow down and let the faster kart pass.  If you are overtaking someone do so safely and let them slow down first.   Any contact between karts will be grounds for instant termination of rental and no refunds will be given. *This is an important safety rule, these karts are drift karts, designed to lose directional control, sliding and skidding on the dirt, grass, and mud.  Therefore a suitable distance must be maintained by all karts at all times.*  You might be the best driver in the world but the person in front or behind you might not be, keep a safe distance at all times.
• Only course marshals are allowed to start, and re-start karts.
• If you have an "oopsie" please turn the kart off (use the on/off switch on the steering wheel) and raise your hands a course marshal will be with you shortly.  
• No riders to touch or put hands near the engine or behind the seat, the engine is hot and it will hurt if you touch it - you have been warned. 
• Only course marshals shall be allowed to refuel karts. 
• All incidents and accidents will be recorded in the incident and accident register. Please see the course marshal. 
• At the end of your time return the Kart to the marshalling area and turn it off (Use the on/off switch on the steering wheel) 
• Non-riders are allowed to view the track from the designated viewing areas - please keep off the track for your own safety.
• Unsafe, dangerous or bad behaviour will not be tolerated  - this is a fun zone, safe for all. The course marshal has the right to refuse entry or remove you from the track without refund or compensation if under the influence of drugs / alcohol or behaving in a disruptive manner.

The directors and employees of Kraken Adventure Sports Limited take all practicable steps to identify and minimise potential dangers. However, you must follow our instructions and correctly use the safety equipment at all times. Adults accompanying any person under the age of 18 must ensure that the underage person follows our instructions at all times. You release or indemnify Kraken Adventure Sports and our staff against any liability we incur to anyone else resulting from your failure or the failure of any person accompanying you, to follow our instructions.

We reserve the right to remove any person who in our opinion is likely to endanger themselves or others. We also reserve the right to cancel the drift karting activity if we become concerned for your safety or that of any other person, for any reason, including the weather situation or forecast.

WARNING: Under New Zealand law it is extremely unlikely that you will be able to sue anyone if you are injured. In addition, New Zealand's accident compensation scheme provides only limited assistance to visitors to New Zealand who are injured. We strongly recommend that all visitors to New Zealand have full insurance covering any injury they might suffer, including medical treatment cover, before undertaking this activity.

EXCLUSIONS: To the extent permitted by law, all our liability for damage to your property, disruption to travel plans, or mental injury is excluded. This exclusion is subject to any rights or remedies you may have under the Consumer Guarantees Act 1993.

Please describe to the course marshal any medical conditions or other information we need to know to include you safely in this activity. For example: asthma, allergies, heart conditions, epilepsy or pregnancy. You are entitled to access any information we hold about you or to request its correction at any time.

Should you cause damage to yourself or any other person and or property of the same, whilst failing to exercise care as directed by the employees of Kraken Adventure Sports Limited you indemnify the directors and employees of Kraken Adventure Sports Limited against all actions, claims or expenses in respect of such injury or damage provided that the directors and employees of Kraken Adventure Sports Limited have not been negligent and have exercised reasonable care and skill in the provision of their services. Should you cause damage to the facilities, race gear, drift karts or race track you will be responsible for covering the costs for replacement or repair.

Kraken Adventure Sports Limited takes no responsibility for personal items that have been lost, damaged or stolen.

Be careful and follow the rules:

I/We will abide by the rules of racing displayed on the premises and written or verbal instructions from the directors or employees of Kraken Adventure Sports Limited.

I/We accept that Kraken Adventure Sports Limited are not responsible for me hurting myself and others if I/We do not follow the safety rules.

I/We am/are responsible for any costs I/We incur for any damage caused.
